The lawsuit against The Pointe Malibu Recovery Center is not just about one patient. In my opinion, it is the luxury rehab industry showing exactly what it is.
Malibu's "Rehab Riviera" runs on a simple promise: pay more, get safer care. The marketing says world-class treatment, holistic healing, and safe environments. But I believe the financial logic cuts the other way. When a single bed generates tens of thousands per month, occupancy must be protected, the brand must be preserved, and problems must be buried before they become visible. A 2024 California State Auditor report confirmed what many already suspected: oversight is failing at the state level.
Premium branding on top. Perverse incentives underneath. Patients caught in between.
That, in my editorial view, is what the Hickman lawsuit exposes. Not just one facility's alleged failures, but a business model that I believe rewards silence over candor and image over integrity. When disclosure threatens the brand, disclosure loses. When a patient's safety conflicts with the census, the census wins.
The facility's conduct in this litigation, in my opinion, reinforces the point. The Pointe Malibu first asked the court to seal the entire complaint from public view. The Honorable Mark H. Epstein denied that request. Then, weeks later, the facility filed a motion to compel private arbitration, seeking to move the dispute out of the public court system entirely and into a proceeding with no public docket, no public hearing, and no public record.
Seal it. If you cannot seal it, leave the courthouse.
We have to ask ourselves why.
Why would a licensed treatment facility that markets transparency and trust fight this hard to keep the public from seeing what happened inside its walls?
The allegations remain unproven and every defendant is presumed innocent. But the pattern of seeking to suppress public access to this case is, in my view, its own kind of answer.
